Terms of Use
Conditions of use, product responsibilities and your rights when using our website or purchasing from Access Heritage.
About these terms
These terms apply to MilitaryHeritage.com, operated by Access Heritage Inc. (formerly The Discriminating General), and to purchases and services agreed with us. Please read them with our Ordering & Returns Policy and Privacy & Security Policy. Specific terms in an accepted written quotation or order apply to that transaction where they differ from these general terms.
Access Heritage Inc., 27 Auriga Drive, Unit 38, Ottawa, Ontario K2E 7X7, Canada. Email: info@militaryheritage.com. Telephone: (646) 907-8444. This is a mailing address; we do not offer order pick-ups.
Your consumer rights
Nothing in these terms excludes or limits a statutory warranty, cancellation right, refund, remedy or other protection that applicable law does not allow us to exclude or limit. This includes applicable protections in your province, state or country. Mandatory law takes priority over any conflicting wording on this website, including in its footer.
Our voluntary return policy is additional to those rights. Its 10-day deadline and shipping deductions do not restrict remedies for defective, misdescribed or undelivered goods, or statutory cancellation rights. No mandatory arbitration or waiver of class proceedings is required by these terms.
Eligibility and responsible use
You must be at least 18 years old and legally able to enter into the transaction to purchase from us. Provide accurate contact, delivery and payment information, and use only payment methods you are authorised to use.
Check applicable rules on purchase, possession, import, transport and display before ordering. Product availability on this site does not mean an item is permitted in every location. We may decline an order that we cannot lawfully fulfil.
Products, handling and historical information
Follow product descriptions, labels and care instructions. Items may have sharp edges, points or small parts and are not toys. Keep them out of reach of children. Do not ingest products or use them with food unless expressly labelled for that purpose. Check materials if you have allergies, including sensitivity to wool. Do not use lead with our products.
Handmade reproductions may vary slightly in finish and dimensions as described for the item; this does not excuse a material departure from the agreed description. Historical research reflects available evidence and may be revised. Any paid advisory service is governed by its agreed scope and applicable legal standards.
Prices, orders and availability
Prices and availability may change for future orders. Review the product, quantity, destination, currency, shipping charges and taxes before submitting an order. The amount and currency agreed for an accepted order will not be changed without your agreement.
An automated receipt acknowledges submission; acceptance occurs when we expressly confirm the order or dispatch it, whichever happens first. If we cannot fulfil an order or identify a material pricing error before acceptance, we will explain the issue and offer correction with your agreement or cancellation and a refund of any payment collected. We will not substitute products without your agreement.
An availability notification request is not an order, payment or stock reservation. Payment options, custom-order deposits, delivery and returns are described in our Ordering & Returns Policy.
Copyright and permitted use
Copyright © 1995–2026 Access Heritage Inc. Except where otherwise identified, original site text, photographs, designs and other protected material belong to us or their respective rights holders. Trademarks and third-party material remain the property of their owners.
You may browse the site and retain copies for your personal reference. Reproduction, republication, commercial distribution or adaptation of protected material requires the relevant rights holder’s permission unless permitted by law. Nothing here restricts fair dealing, public-domain material or other lawful uses. Permission to use content does not imply endorsement or grant rights in our name or logo.
Website use and third-party services
Do not use this website for fraud, unlawful activity, malicious code, unauthorised access, interference with its operation or infringement of others’ rights. We may restrict access reasonably necessary to protect the site, customers or legal compliance; this does not cancel our obligations on accepted orders.
External websites and payment services may have their own terms and privacy policies. Links are provided for convenience and do not constitute endorsement. We do not control third-party content, but using a service provider does not remove responsibilities that the law places on us.
Privacy and communications
Our Privacy & Security Policy explains our handling of personal information. Provide only information needed for your inquiry or transaction. Do not send card numbers or security codes by email.
We may communicate about your inquiry, order, delivery or service using the contact details you provide. Promotional messages and stock alerts are subject to applicable consent and unsubscribe requirements. Purchasing does not require consent to unrelated marketing. These terms do not grant us ownership of material you submit.
Website warranties and liability
We take reasonable care with the site but cannot promise uninterrupted access or that every historical article is complete or free of error. To the extent permitted by law, general website information is provided “as is” without additional warranties. This qualification does not remove express commitments in an accepted order, statutory product warranties or obligations for services.
To the extent permitted by applicable law, we exclude liability for indirect or consequential loss arising from use of general website information. We do not exclude liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded. These terms do not impose a blanket exclusion of responsibility for our products, delivery or advice.
You are responsible for loss caused by your unlawful use, misuse or unauthorised alteration of a product to the extent provided by law. Customs decisions and carrier delays do not automatically remove either party’s legal obligations or the customer’s cancellation and refund rights.
Changes, applicable law and disputes
Updates apply prospectively. The terms provided when an order is accepted continue to govern that order unless a lawful change is agreed. Keep a copy of your order and the policies supplied with it.
Subject to mandatory consumer protections, Ontario law and applicable Canadian federal law govern these terms. This does not deprive you of mandatory protections or access to courts in a jurisdiction that applicable law permits. If a provision is unenforceable, the remainder applies only to the extent lawful. A failure to enforce a provision is not a waiver of future rights.
If an issue arises, write to info@militaryheritage.com with your order reference and requested resolution. This does not require you to contact us before exercising a statutory remedy or impose a shorter legal deadline.
